End User License Agreement & Terms of Service

1. Acceptance

By downloading, installing, purchasing, or using DUNNO ("the App"), you agree to this End User License Agreement and Terms of Service ("Terms"). If you do not agree, do not install or use the App.

Nothing in these Terms limits your statutory rights as a consumer under applicable law, including mandatory EU consumer protection law.

2. The App and its editions

DUNNO is a proprietary, closed-source Android messaging application that uses the Tor network for peer-to-peer communication. The App provides text messaging, file sharing, walkie-talkie (PTT), and audio/video calling. No central messaging server is operated by the developer — all communication is direct between users.

The App is distributed in two editions:

Both editions are governed by these Terms. The two editions are technically separate apps: your identity, keys, and messages can be transferred between them only via the App's built-in encrypted backup/export function.

3. License grant (all editions)

DUNNO is licensed, not sold. The developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal, lawful purposes, in accordance with these Terms. All rights not expressly granted are reserved by the developer. The App and its source code are protected by copyright and other intellectual property laws.

You may not, except (a) to the extent such restriction is prohibited by mandatory applicable law, or (b) with our prior written consent (see Section 4):

4. Security research

We applaud independent, good-faith security research on DUNNO. Closed source does not mean closed to scrutiny. If you wish to investigate the App beyond normal use, you can request our prior written consent via the email address listed on our website or on the Google Play Store listing. Depending on the nature of the research, permission may cover:

We ask that you: report any vulnerability to us first and allow us reasonable time to fix it before public disclosure; conduct your research only with accounts and data you own or have explicit permission to use; stop and report immediately if you unintentionally encounter data belonging to other users; and do not degrade the service. Note that messages you receive from your own contacts are stored on your own device by design — this is normal use of the App and is not restricted by this section. Good-faith research under these conditions is welcome and will not be met with legal action.

5. Google Play edition — free tier and subscription

Free tier. The Google Play edition can be downloaded and used free of charge with limited functionality. The current limits are shown in the App and on the Play Store listing. The developer may adjust the free tier with reasonable notice.

Subscription. Full functionality requires a paid in-app subscription, processed exclusively by Google Play Billing:

6. DUNNO Direct — one-time purchase via the website

Perpetual license. A one-time purchase on the developer's website grants you a perpetual license to use the DUNNO Direct edition, subject to these Terms. Payment is processed by the developer's payment provider (currently BTCPay Server; prices are displayed in EUR and settled in cryptocurrency).

Personal download link. After payment you receive a personal download link (token). This link is your proof of purchase — keep it safe. The link:

License and activation terms. You accept the following technical characteristics of the Direct edition:

Withdrawal right (EU consumers). You have a statutory 14-day right of withdrawal for digital purchases. However, when you check out, you expressly consent to immediate delivery of the digital content and acknowledge that you thereby lose your right of withdrawal once the download link is issued.

Refunds. Cryptocurrency payments cannot be reversed automatically. Where a refund is legally required or approved by the developer, it will be issued in EUR. Licenses purchased fraudulently, chargebacked, or obtained by abuse may be revoked without refund.

7. Your data

All messages, contacts, keys, and settings are stored exclusively on your device in encrypted form. The developer cannot read your messages, restore your data, or reset your identity. Your data is and remains yours: the encrypted backup/export function is always available to you, in every edition, regardless of subscription or license status.

8. No warranties

The App is provided "as is" and "as available", without warranty of any kind, express or implied, to the maximum extent permitted by applicable law. The developer does not guarantee that the App will be uninterrupted, secure, or error-free. You use the App at your own risk. This does not affect your statutory warranty rights as a consumer.

9. Limitation of liability

To the maximum extent permitted by applicable law, the developer is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to data loss, privacy breaches due to user error, or damages resulting from intercepted communications. Nothing in this section excludes or limits liability for intent (opzet) or deliberate recklessness (bewuste roekeloosheid), or any other liability that cannot be excluded under mandatory law.

10. Privacy

Your privacy is governed by the Privacy Policy, which is incorporated into these Terms by reference. The full Privacy Policy is available at eelke-sp.cc/dunno/privacy.html. Payment processing for the two editions is handled by Google Play Billing (Google Play edition) and the developer's payment provider (Direct edition) — details are in the Privacy Policy.

11. Third-party open-source components

The App contains third-party open-source software, used under the following licenses. The App itself remains proprietary; these licenses apply only to the respective components.

12. Changes to these Terms

The developer may update these Terms. The current version is always available at this address and in the App (Settings → Legal). For material changes affecting paying users, reasonable notice will be given. Continued use after a change constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law entitles you as a consumer to bring proceedings before the court of your place of residence.
